We are committed to ensuring that the app is as useful and efficient as possible. For that reason, we may make changes to the app or charge for certain services at any time and for any reason. We will never charge you without making it clear what you are paying for.
The BirthdayBeats app stores and processes personal data that you provide to us to deliver the Service. It is your responsibility to keep your device and access to the app secure. We recommend that you do not jailbreak or root your device, which removes limitations imposed by the official operating system. Doing so may make your device vulnerable to malware/viruses/malicious programs, compromise security features, and cause the app to not work properly or at all.
BirthdayBeats is provided for entertainment and personal use. It should not be considered professional advice of any kind. We strive to make the app as useful and reliable as possible, but we cannot guarantee that the content is error‑free or suitable for every purpose. The app is provided "as is" and you use it at your own risk.
The app uses data and information provided by you to create personalized song cards and previews. While we implement security and quality measures, you acknowledge that content generation and media processing involve inherent risks. Your use of these features constitutes your consent to this processing.
You agree to use the app only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the app. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, infringing intellectual property rights, or disrupting the normal operation of the app or our services.
When you create an account with us, you affirm that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate suspension or termination of your account.
The app offers in‑app purchases for credits used to create digital birthday cards and related content.
Because these are digital goods that are delivered or consumed immediately, all sales are final once delivery begins or a credit is consumed, except where a refund is required by applicable law. If we are unable to deliver a purchased item due to a verified technical issue on our side, we will complete delivery, replace the credit, or provide a refund or store credit, at our reasonable discretion.
If you believe a purchase was unauthorized, accidental, or duplicated, please contact the store where you made the purchase (for example, the Apple App Store or Google Play). The store’s policies may govern eligibility for refunds. You can also contact us at support@birthdaybeats.art and we will assist where possible.
Your statutory rights are not affected. For EU/UK consumers: by requesting immediate delivery of digital content, you acknowledge that the 14‑day right of withdrawal may be lost once delivery begins.
We value your experience. If you are unhappy with a generated result, reach out with your order details — we often provide a courtesy replacement credit to make it right.
The app may display, include, or make available third‑party content (including data, information, applications, and other products or services) or provide links to third‑party websites or services ("Third‑Party Services"). You acknowledge and agree that we are not responsible for any Third‑Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect. We do not assume and will not have any liability or responsibility to you or any other person for any Third‑Party Services.
You retain your rights to any content you create or upload in the app. By creating, uploading, or sharing content through the app, you grant us a non‑exclusive, worldwide, royalty‑free license to host, store, reproduce, and display that content solely as needed to operate, improve, and provide the Service (for example, to generate previews, enable sharing, and maintain backups). You are responsible for the content you create and share and must ensure you have the necessary rights to use it.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason and without limitation, including but not limited to a breach of these Terms.
These Terms are governed by the laws applicable in your country or region of residence, without regard to its conflict of law provisions. Local mandatory consumer protection laws may also apply.
In no event shall BirthdayBeats, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use, or alteration of your transmissions or content.
To the maximum extent permitted by law, our total liability for any claims relating to the Service will be limited to the amount you paid us, if any, for the Service in the twelve months prior to the event giving rise to the claim.
If you participate in a beta testing program for BirthdayBeats (the "Beta Program"), you agree to the following additional terms:
- Pre‑Release Software: You acknowledge that beta versions are pre‑release software and may contain bugs, errors, or inaccuracies. You use beta versions at your own risk.
- Data Collection: As outlined in our Privacy Policy, participation in the Beta Program may involve additional usage and performance data collection to help us improve the app. Your participation constitutes consent to this data collection.
- Feedback: You may be asked to provide feedback, which we may use without obligation.
- Confidentiality: You may be required to keep information about the beta version confidential.
- No Warranty: Beta versions are provided "as is" without warranty of any kind.
